1. Acceptance of these Terms

These Terms of Use (“Terms”) are an agreement between you and Yana Demko (“we”, “us”, or “our”) regarding your use of the Povryn iOS application (“Povryn” or the “App”).

By downloading, installing, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. The App

Povryn provides web-browser functionality, which may include opening websites, using multiple tabs, viewing browsing history, managing downloads, using start-page shortcuts, searching the web, viewing advertisements, using an optional proxy for pages opened inside the App, and accessing optional paid features.

Features may change, be added, be removed, or become unavailable depending on App version, device, region, technical limitations, or third-party service availability.

3. Limited license

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for lawful personal use and in accordance with Apple App Store rules.

Except where applicable law permits otherwise, you may not copy, sell, sublicense, rent, distribute, reverse engineer, attempt to extract source code from, or create derivative works of the App.

4. Your responsibilities

You are responsible for how you use Povryn and for content you choose to access, download, upload, submit, or share through websites and online services.

You agree not to use the App:

• in violation of applicable laws or regulations;
• to infringe intellectual-property, privacy, publicity, or other rights;
• to distribute malware, harmful code, spam, fraud, or deceptive content;
• to interfere with the App, another service, network, or user;
• to bypass technical restrictions or access controls that you are not authorized to bypass.

If you turn on a proxy, you choose the server. You are responsible for that choice and for what you open through it.

5. Websites and third-party services

Povryn gives you access to websites and online services operated by third parties. We do not own or control those websites, their content, products, security practices, availability, or data practices.

Your use of a third-party website or service is governed by that third party’s own terms and policies. The presence of a link, search result, advertisement, or website in the App does not mean that we endorse or guarantee it.

You are responsible for deciding whether to trust, access, download from, purchase from, or provide information to any third-party website.

6. Advertising

The App may contain advertising supplied by third parties, including Google AdMob. Advertisements may link to external websites, applications, products, or services.

We are not a party to transactions between you and an advertiser unless we expressly state otherwise. Third-party advertising and linked destinations are subject to the advertiser’s own terms and policies.

7. In-app purchases and subscriptions

Povryn may offer optional paid products or subscriptions through the Apple App Store. The price, billing period, introductory offer or trial (if any), and renewal information are displayed in the purchase flow before you confirm a transaction.

Payments are processed by Apple. Subscriptions may renew automatically unless cancelled before the next renewal in accordance with App Store rules and the terms shown at purchase.

You can manage or cancel App Store subscriptions through your Apple ID subscription settings. Refund eligibility is determined by applicable law and Apple’s refund policies. We do not receive your complete bank card details.

We may use a subscription-management service such as Adapty to display paywalls, validate purchase status, and provide purchased access. This does not replace the billing relationship between you and Apple.

Deleting the App does not necessarily cancel an active App Store subscription. Subscription cancellation should be completed through your Apple ID.

8. Updates and availability

We may release updates, modify features, impose technical limits, or discontinue all or part of the App. Some updates may be required for continued use.

We do not guarantee that the App, any website, ad, search provider, proxy, payment service, or other third-party integration will always be available, uninterrupted, or compatible with every device or iOS version.

9. Intellectual property

The App, its design, code, branding, graphics, and other materials owned by us are protected by applicable intellectual-property laws. These Terms do not transfer ownership of our intellectual property to you.

Websites, logos, content, trademarks, and materials displayed through the browser may belong to third parties and remain subject to the rights of their respective owners.

10. Disclaimers

To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis. We do not make warranties that the App will be uninterrupted, error-free, compatible with every website, or free from all harmful third-party content.

Internet browsing involves third-party networks, websites, downloads, proxies, and content outside our control. You are responsible for using appropriate judgment when visiting websites, turning on a proxy, or downloading content.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

11. Limitation of liability

To the maximum extent permitted by applicable law, Yana Demko will not be liable for indirect, incidental, special, consequential, or punitive losses arising from third-party websites, third-party content, advertising, downloads, proxies, or your misuse of the App.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under mandatory consumer law.

12. Suspension or termination

You may stop using Povryn at any time and uninstall the App. We may suspend or discontinue access to some or all App functionality where reasonably necessary for legal, security, technical, policy, or service reasons.

Ending use of the App does not automatically cancel an active subscription billed by Apple.

13. Changes to these Terms

We may update these Terms to reflect changes to the App, our services, third-party integrations, legal requirements, or business practices. The current version will be published with a revised effective date.

Your continued use of the App after updated Terms take effect constitutes acceptance to the extent permitted by applicable law. Where law requires a different form of notice or consent, we will follow that requirement.

14. Governing law

These Terms are governed by applicable law, without limiting any mandatory consumer protections or rights that apply to you under the laws of your country of residence.

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
